The thing is, that who makes thedecision about whether it benifits the community or not? The fat politician that plays golf with the developer every week? Or the old couple that has lived in their home for 50 yrs and put everything they had into it with 50 million knicknacks, pictures, marks on the wall from thier kids growing up and things that make it thier home?

I think it goes agaist everything that America is about -- working hard to own your own piece of land, your own house, your own little spot on this earth. Unless it is a health hazard, physically dangerous, or in some way harmful to the community there is no reason to force someone who owns it to give it over to a private corporation. Robert Moses abused emminent domain in NYC during the 50's, 60's and 70's and destroyed neighborhoods, families, lives all for the supposed benefit of society. If you have every been on the cross Bronx express way you know that is a special place in hell that benefits no one.

I like the idea of owning land, but it does not exist. You essentially lease parcel #123456789102 from the government. Merely purchasing the right to fix up the property that you reside in. That is all. Stop paying "rent" aka taxes and see how long your property is yours. The most disgusting tax that I have come across is called Personal Property Tax. Any moveable property residing on the business presmises is subject to taxation. For example, computers, paintings, pictures, shelves, tables, chairs are all subject to taxation. As well as software for any PC's. Can you say Bull shit? /rant off

Laws are very sketchy and can be bent and construed. Judges need accountability.

They essentially rewrite the constitution. The problem is they should simply say it does or does not pass constittional muster and ship the "remedies" back to Congress. The problem with the courts today is they like to "solve" problems instead of simply saying there is a law or is not a law. Rahl

The Federal Court system has drawn more and more power to itself in the past 50 years by rulings that have stretched and rationalized the constitution far beyond anything the founders would have imagined. In fact the "interstate commerce" portion has been over worked more than just about any of the with the possible exception of the "equal protection" clause. With the courts, both conservative and liberal, taking liberties they have weakened the our Republic style governing system with their autocratic decisions. The founding fathers figured that each state could set themselves up the way the majority of the people would see fit so long as they didn't break the few rules outlined or expressly governed by the constitution. Today the courts have rationalized so many things to be under the "governance" of the Constitution as to eviscerate the States abilities to self govern. This is why I think there is such a cultural backlash in this country because the courts have in effect over stepped their bounds. This isn't just a dem and republican issue. The courts are "conservative" today. This is the Living document argument and I for one want a dead carved in stone commandment style one that everyone who hasn't studied case law would easily understand. That is what I think we have and that is what I think has been rationalized away. The courts don't make decisions based on the constitution they make them based on some other dead dudes interpretation. That is the problem as I see it. Rahl

Equal results are not. I don't blame the court entirely however I do believe that they have way over stepped the intended purpose of the Constitution. If the Founding Fathers knew what the court would do they would have created more checks on their power. As it stands now the best I can hope for is to have judges appointed who will actually read the Constitution when they make decisions and not just read the prior decisions of the court.
