eminent domain has been around since the constitution was written, if i am not mistaken. this should be true though, considering it is part of the Fifth Amendment.
This is a big deal around here, as a construction company is wanting to build a private freeway (pay road) which will stretch through a lot of rural farm communities in the area (from this side of Denver all the way to Golden). The state has basically told him that it is ok for him to condemn the land that he needs, so everyone is flipping out (rightfully so).
Also, years ago my boss lost some of his property to the FAA. They decided they needed a radio tower right around the location of his land, so poof...there's a tower on his land now.

didnt happen to my grandmother but it affected her.
She lived in what was once a nice suburb or Chicago. They decided they needed a freeway and that it would run through a neighbors property.
Long story short she now has a wonderfull view of the freeway.

Eminent Domain can only be used to sieze property for Government use (highways, etc). This new decision allows the siezure of property for use by private companies if the government deems the use as a benefit to the community.

Kicking some 80 yr old couple out of a Victorian home in a decent neighborhood to build a hotel, health club and office building is not for the good of the public. It's for the good of the rich bastard that pays off public officials to get what he wants. Those ppl don't give a fuck about if they get fair market value, they want to livbe the rest of their lives in the home they raised their family in, the home that has all their memories
I could see in the cases where they are taking a shithole part of a town and trying to fix it up, but that really isn't what will be happening most of the time. Developers want decent areas to build in where ppl have money to spend..
